A badly drafted dispute clause or a poorly managed hearing can cost a company more than the claim itself. Experienced contract managers, lawyers and commercial leaders attend this five-day programme to sharpen their handling of high-value disputes outside the courtroom. Early sessions look at how to choose between negotiation, mediation, expert determination, adjudication and arbitration, and how to write multi-tier clauses that work under pressure.
You then follow an arbitration from notice to award: selecting the seat and tribunal, applying institutional and UNCITRAL rules, pleadings, document production, witness and expert evidence, interim relief and costs. A full day is given to mediation technique, including preparing a client, opening statements, caucus work, reality testing and drafting a settlement agreement. The last day covers recognition and enforcement under the New York Convention, challenges to awards and dispute avoidance in construction, energy, procurement and finance contracts. It is aimed at legal counsel, contract managers, procurement and project directors, claims specialists, public sector officers and private practitioners moving into dispute work. Delivery is classroom, online or in-house, with a CPD-accredited certificate. You finish able to build a case strategy and negotiate a settlement.
Commercial relationships in Africa and beyond increasingly depend on private dispute resolution, because it offers confidentiality, specialist decision makers and awards that travel across borders. Yet many organisations only discover the weakness of their arrangements when a dispute is already live: the clause names no seat, the rules are unclear, or key records were never preserved.
The Advanced Arbitration, Mediation & Dispute Resolution Training Course covers the whole spectrum of resolution methods at a level suited to people who already manage contracts or disputes. Participants study how to design the process in advance, how to prepare and present a case, and how to settle when settlement serves the client better than victory. Topics include the powers of tribunals, evidence and procedural orders, ethical duties of counsel and mediators, third-party funding and cost allocation, and the practical limits of enforcement.
The programme relies on case files, mock procedural conferences and mediation simulations. Participants practise advocacy and negotiation in small groups, receive structured feedback and finish with a case plan for a dispute they currently manage or anticipate.
