Disputes are an unavoidable feature of commercial life, particularly in construction, procurement, energy, finance and cross-border trade. What separates well-run organisations from the rest is not whether they face disagreements but how early they see them coming, how realistically they value them and how deliberately they pick a route to resolution. Poor choices turn manageable claims into long, costly proceedings that consume management time and strain relationships with customers, suppliers and funders.
This programme applies the discipline of risk management to arbitration, mediation and wider dispute resolution. It begins with the sources of disputes and early warning signs in contracts and project records, then builds a dispute risk register with likelihood, impact and cost scoring. Participants examine each process in turn, from negotiation and mediation to adjudication, arbitration and litigation, and learn how clause drafting, seat, governing law, institutional rules and evidence management shape risk before any claim is filed.
The later sessions cover case budgeting, funding, settlement strategy, reporting to boards and enforcement of outcomes across borders. Teaching combines legal and commercial perspectives through case studies, role plays and drafting exercises, so that participants finish with a decision framework they can apply to live matters in their own organisations.
